Terms of Service

By accessing or using the TradesmenAI application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

TradesmenAI provides a mobile and web application designed to help tradespeople manage quotes, invoices, jobs, clients, and business operations. Features include AI-assisted quoting, scheduling, automated follow-ups, expense tracking, and client relationship management.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

You are responsible for safeguarding the password used to access the Service and for any activities or actions under your account. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use another person's account without their permission. Account credentials may not be shared across multiple users.

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Transmit any unsolicited or unauthorized advertising or promotional material.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses or any other malicious code.
• Attempt to gain unauthorized access to any part of the Service or its related systems.
• Collect or harvest any personally identifiable information from the Service without consent.

You may input data about your clients, including names, phone numbers, email addresses, and physical addresses. You are solely responsible for obtaining any necessary consents from your clients for storing and processing their personal data within the Service.

TradesmenAI processes your data in accordance with our Privacy Policy, which is incorporated into these Terms by reference.

Certain features of the Service may require payment of fees. All fees are stated in US Dollars and are non-refundable except as expressly set forth in these Terms or as required by applicable law.

Payment processing is handled by third-party providers (including Stripe). By submitting payment information, you authorize TradesmenAI and its payment processors to charge the applicable fees. We do not store raw payment card data.

The Service and its original content, features, and functionality are and will remain the exclusive property of TradesmenAI and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain ownership of all content you submit through the Service, including client data, quotes, invoices, and photos. By submitting content, you grant TradesmenAI a limited, non-exclusive, royalty-free license to store, process, and display that content solely to provide the Service to you.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

TradesmenAI does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by applicable law, TradesmenAI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

In no event shall TradesmenAI's total liability to you exceed the greater of (a) the amount you paid to TradesmenAI in the twelve months preceding the claim, or (b) one hundred US Dollars ($100).

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. You may export your data prior to termination. If you wish to terminate your account, you may simply discontinue using the Service and contact us to request deletion.

These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Texas.

We reserve the right to modify or replace these Terms at any time. We will provide reasonable notice of any material changes by updating the effective date at the top of this page and, where appropriate, notifying you by email.

Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
